These Terms of Service ("Terms") are an agreement between you and Sierro, Inc., a Delaware corporation. They apply to Sierro websites, online stores, mobile applications, connected-product services, and other services that link to these Terms.

Acceptance and scope
By accessing or using the services, creating an account, or placing an order, you agree to these Terms and our referenced policies. If you do not agree, do not use the services.
Additional terms may apply to a particular product, protection plan, promotion, app feature, or service. If additional terms conflict with these Terms, the more specific terms control for that subject.

Eligibility and accounts
You must be legally able to enter a binding agreement in your jurisdiction. If you use the services for an organization, you represent that you have authority to bind it.
Provide accurate information, keep account credentials confidential, and notify us promptly of suspected unauthorized access. You are responsible for activity through your account to the extent permitted by law.

Products, pricing, and orders
We work to present product descriptions, specifications, availability, pricing, and imagery accurately. Minor differences may occur, and estimated runtimes vary with load, device behavior, temperature, battery condition, and other real-world factors.
An order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasons including availability, pricing or description errors, suspected fraud, address or payment problems, legal restrictions, or reseller activity. If we cancel after payment, we will issue the appropriate refund.
Prices, discounts, taxes, shipping options, and payment terms are shown before purchase. You authorize the selected payment provider to charge the amount displayed at checkout.

Acceptable use
You may use the services only for lawful, personal, household, or authorized business purposes. You may not:
- Violate law, another person's rights, or these Terms.
- Interfere with security, availability, networks, or other users.
- Introduce malware, scrape or harvest data without authorization, or attempt to bypass access controls.
- Reverse engineer, copy, modify, or create derivative works from the services except where applicable law expressly permits it.
- Use false information, impersonate another person, or use the services for fraud, resale abuse, or harmful activity.

Apps and connected products
Some features require a compatible device, internet access, Bluetooth, Wi-Fi, an account, or third-party platform. Availability can vary by product, region, software version, and network conditions.
We may provide updates for security, reliability, compatibility, or features. Do not rely on the app or product as a substitute for emergency services, professional medical equipment requiring uninterrupted zero-transfer power, or any use prohibited by the User Manual.
You are responsible for following setup, electrical, ventilation, environmental, and safety instructions supplied with the product.

Intellectual property and feedback
The services, software, designs, text, images, trademarks, and other content are owned by Sierro or our licensors and protected by applicable law. These Terms grant only a limited, revocable, non-exclusive, non-transferable right to use the services as intended.
If you voluntarily provide feedback or ideas, you grant Sierro a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or compensation, subject to our Privacy Policy.

Disclaimers and limitation of liability
Except for express written warranties and rights that cannot be excluded by law, the services are provided "as is" and "as available." We do not promise that digital services will always be uninterrupted, error-free, or compatible with every device or network.
To the fullest extent permitted by law, Sierro and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profit, revenue, business, or use; or damages arising from events outside our reasonable control.
To the fullest extent permitted by law, Sierro's aggregate liability arising from the services will not exceed the amount you paid Sierro for the product or service giving rise to the claim during the 12 months before the event. These limits do not apply where prohibited by law.

General terms
Third-party services
Links, payment methods, app stores, carriers, retailers, and other third-party services are governed by their own terms. Sierro is not responsible for independent third-party services.
Suspension and termination
We may suspend or terminate access where reasonably necessary to protect users, security, legal compliance, or the services. Provisions that by nature should continue will survive termination.
Changes
We may update these Terms. The current version will be posted with a revised effective date. Continued use after changes become effective means you accept the updated Terms where permitted by law.
Severability and waiver
If a provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; Sierro may transfer them in connection with a business transaction.
Applicable law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles and without limiting mandatory consumer protections available in your place of residence. Any dispute must be brought in a court with lawful jurisdiction unless the parties agree to another permitted resolution process.
